1. Definitions
- 1.1 "Contractor" refers to Kent Building Contractors Ltd.
- 1.2 "Client" refers to the individual or entity engaging the Contractor.
- 1.3 "Works" refers to the services, labour, and materials outlined in the quotation.
- 1.4 "Quotation" or "Estimate" refers to the document provided by the Contractor detailing the proposed scope and cost of Works.
2. Quotations & Scope of Works
- 2.1 All quotations are valid for a period of 90 days from the date of issue.
- 2.2 The quotation represents the full scope of works proposed based on information available at the time.
- 2.3 Any works requested outside the agreed scope will be treated as a variation and may incur additional charges.
- 2.4 The Contractor reserves the right to charge £50 + VAT per hour for any deviations, custom works, or variations from the original plans or agreed schedule.
3. Site Measurement & Adjustments
- 3.1 All quoted rates are subject to a "true site measure" upon completion.
- 3.2 Where discrepancies greater than 10% are identified between estimated and actual works, the Contractor reserves the right to adjust costs on a pro rata basis.
- 3.3 Pro rata rates apply only while the relevant works are actively being carried out.
4. Prime Cost (P.C.) Items
- 4.1 Any items identified as "Prime Cost" (P.C.) within the quotation are allowances only.
- 4.2 Any increase or decrease in the actual cost of P.C. items will be passed on to or credited to the Client accordingly.
5. Materials
- 5.1 All materials supplied remain the responsibility of the Client once delivered to site.
- 5.2 No refunds will be issued for materials delivered, except where items are proven to be faulty or damaged.
- 5.3 The Contractor accepts no liability for the performance, suitability, or warranty of client-supplied materials or products.
6. Compliance
- 6.1 All works will be carried out in accordance with current Building Regulations where applicable.
- 6.2 It is the Client's responsibility to ensure that any required permissions, approvals, or planning consents are obtained unless otherwise agreed in writing.
7. Payment Terms
- 7.1 Payment terms will be outlined within the quotation or invoice.
- 7.2 The Contractor reserves the right to charge interest at a rate of 2% per month on any outstanding balances exceeding 14 days from the invoice date.
- 7.3 The Contractor reserves the right to suspend works until overdue payments are settled.
8. Variations & Additional Works
- 8.1 Any changes to the agreed scope must be confirmed in writing.
- 8.2 Variations may affect both cost and completion timelines.
- 8.3 Additional charges will apply for all approved variations.
9. Warranty
- 9.1 The Contractor provides a 12-month parts and labour warranty on all supply-and-fit projects, commencing from the date of completion.
- 9.2 No warranties are provided for works involving client-supplied materials or products.
10. Liability
- 10.1 The Contractor will carry out all works with reasonable skill and care.
- 10.2 The Contractor shall not be liable for:
- Indirect or consequential losses
- Delays caused by factors beyond reasonable control, including weather, supplier delays, or site access issues
- Defects arising from pre-existing conditions or client-provided specifications
11. Cancellations
- 11.1 Any cancellation must be provided in writing.
- 11.2 The Contractor reserves the right to charge for all works completed and costs incurred up to the cancellation date.
12. Access & Site Conditions
- 12.1 The Client must provide safe and reasonable access to the site for the duration of the works.
- 12.2 The Contractor reserves the right to delay or suspend works if site conditions are deemed unsafe or unsuitable.
13. Governing Law
- 13.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.
14. Acceptance
- 14.1 Acceptance of the quotation, whether written or verbal, constitutes agreement to these Terms & Conditions.
